11/10/2009 - ProvidrSoft® Trademark We have recently found a possible trademark infringement by ProviderSoft LLC out of Moorestown, NJ and have requested they discontinue to use of the name effective immediately. ProvidrSoft® based out of Indianapolis, IN and an Illinois Corporation has been using the trademark ProvidrSoft® since March 1999. ProvidrSoft® was officially registered as a trademark on July 4, 2000 with the United States Patent and Trademark Office under the International Class Codes 009 listed as "Computer Software, namely, software for use in medical practice billing, collections and appointment calendaring" and 042 listed as "Computer consulting services, namely, integration of computer systems and networks, computer software installation services, and technical support services, namely, troubleshooting of computer hardware and software problems by telephone, e-mail and in person".
We feel the use of ProviderSoft by ProviderSoft LLC is an infringement on our trademark ProvidrSoft® since we our both providing software and services to the health care market. To date we have identified four instances were their use of ProviderSoft in the health care market has presented problems and confusion. Once while working with Availity, LLC, once while working out a contract with LabCorp and another time confusion was caused by the name ProviderSoft being listed in a directory published by MSMS Connect. There was also a court case filed in the State of New York, "Shema Kolainu-Hear Our Voices" where ProviderSoft LLC was named as the defendant which was brought to our attention.
The use of ProviderSoft in the same industry for software and services we feel is highly confusing with our registered trademark, ProvidrSoft®. If someone mentioned ProvidrSoft to you, how would you spell it if you went online to research the company. The natural instinct would be to spell it with an 'e' included. This spelling would exclude us from web searchs where someone might truly be looking for ProvidrSoft®. We are uncertain of the economic impact this may be having on our business.
